OK,
If it's illegal it goes. I don't care "if no body owns the land" because that just shows your ignorance, land is always owned in one form or another and the all don't like MTB trails on their without their permission. (Crown Land, Council land etc).
Follow IMBA principles on building good trails. Focus on how you're going to get the water off the trail quickly. Avoid heavy braking as that creates ruts, think of rather grade reversals that allow riders to wash off speed.
Know what benching the 10% rule is, grade reversals and flow is. If you don't, don't build a trail until you do.
Oh and most importantly.
Don't put nails/bolts into live trees.
Hopefully we can expand this info for you guys to help each other out. Trails are great, we should have more trails, but we should take the time and effort to make trails that we are proud of.
