After making a sh*t tonne of noise, countless phone calls and emails I have gotten a resolution. My funds have been returned.
If you find yourself in this situation, don't stop trying. It took me a little over 2 months but it can be done.

Yes it has been taken down for a while now. I reported them to consumer affairs and ACORN so good to see something got done.
