I'm not sure how we've moved from repeat, violent offenders being back on the streets time and again, to the innocent being convicted.

The Vic Gov't also now have to deal with the pantomine that played out the other day, where offenders from the Malmsbury juvenile justice facility broke out and committed armed robberies, car thefts and aggravated burglaries.
Because it's been characterised as a failure of the courts and bail system, and the legal and moral underpinnings of it. When bail can be revoked by breaching bail conditions, and the offenders behaviour on the day, including confrontations with the police, would easily be grounds for re-incarceration, it seems likely that the failure in the system is with the executive, not the judicial or legislative parts of the system. Also, if juvenile offenders are breaking out of incarceration, that's not a failure of the criminal justice system, but a failure of the physical security of the penal institution in question.

If he was in a "show cause" situation with regard to getting bail when put before the bail justice, and the police opposed bail but he was bailed anyway, that bail justice will have to demonstrate what cause was shown.

In this case unfortunately, before a coronial inquest.

Despite the blame seemingly being laid at the whole bail justice system, it has worked fine for a long time. And magistrates set bail in most cases.

Agree about the unsuitability of the juvenile facility if an escape was that easy.
