I have mine mounted up on the top bar to the far LH side. Technically it's still not legal as the max height of a number plate it 1100mm from the ground. Haven't heard of anyone over here in Tassie getting pinged but it's only a matter of time. Vertical racks or any rear mounted racks for that matter are everywhere.From Bakebook.
Personally I always have an official bike rack plate on the rack as the numberplate on a Landcruiser is completely obscured with a vertical rack.
I'm taking from his post he had no plate on the rack when fined (picture shows one)

I think it’s like a lot of things. Run into a cop on a bad day, attract attention to yourself, or be a dick about it when pulled over, and you’ll likely cop a ticket.There's a lot of things that aren't legal but aren't actively enforced, like in most states you are not allowed to have your rack fitted if you don't have bikes on it. You are also not allow to have those caravan mirrors fitted unless you are actually towing a caravan.
Hopefully my attempt to keep it legal will keep most cops happy.
Some of the bike rack things are true, due to exceeding the length of vehicle and most racks being black, then your 'supposed' to have a marker on the end of it. Usually this is a bike but if no bike is mounted then should be a flag or similar such as when the tradies have to put a marker on the exceeding end of pipe out of back of ute etc.I have mine mounted up on the top bar to the far LH side. With the fuel prices, its a wonder people still leave these on, I get ease of use but I wonder how many km's it adds to petrol use?
With my Single Trail Rack and using the RAVs fuel economy readout, it doesn't seem to make a huge difference in general driving. I might try it one day, to just drive a set route, one with the rack and one without the rack and see what the difference is.Quick edit:
